These Terms of Service govern purchases from ExSafe (www.exsafe.shop). By placing an order or accepting a quote, you agree to these terms. ExSafe sells primarily to businesses; if you are buying on behalf of a company, you confirm you are authorized to do so.

1. Products and intended use

  • ExSafe supplies explosion-proof and Ex-certified equipment (for example ATEX/IECEx-certified ventilators, lighting and power distribution) intended for use in hazardous locations by trained personnel.
  • The buyer is responsible for confirming that the equipment's certification, gas group, temperature class and protection rating are suitable for the hazardous-area classification at the point of use (for example NEC 505 Class I, Zone 1 or Zone 2) and acceptable to the authority having jurisdiction.
  • Equipment must be installed, used and maintained in accordance with the manufacturer's instructions and applicable codes (such as the NEC). Product information on this site is provided for guidance; the manufacturer's documentation and certification marking govern.

2. Prices, quotes and payment

  • All prices are in US dollars (USD) and are shown at manufacturer's suggested retail price (MSRP) unless a quote states otherwise.
  • Prices exclude applicable taxes. Standard shipping is free on every order shipped within the United States.
  • Written quotes are valid for 30 days unless stated otherwise. We may correct pricing or description errors and will contact you before shipping if an error affects your order.
  • Sales tax is charged where required. Tax-exempt buyers must provide a valid exemption or resale certificate before the order ships.

3. Orders and acceptance

An order is accepted when we confirm it. We may decline or cancel orders (with a full refund) where we are unable to supply the items, pricing is in error, or we cannot verify the order.

4. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund & Returns Policy. We ship to addresses in the United States only, and standard shipping is free.

5. Warranty

Products are covered by the applicable manufacturer warranty. Except as stated in that warranty and to the extent permitted by law, ExSafe makes no other warranties, express or implied, including merchantability or fitness for a particular purpose.

6. Limitation of liability

To the extent permitted by law, ExSafe's total liability for any claim relating to a product is limited to the amount paid for that product, and ExSafe is not liable for indirect, incidental or consequential damages, including lost production or downtime.

7. Export

Products are sold for use in the United States only. The buyer agrees not to export or re-export products in violation of US export laws.

8. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in San Diego County, California.
